Official Contest Rules

 

A complete copy of these rules can be obtained at the offices of radio stations 100.7 KHAY (collectively “the Stations”), and/or 95.1 KBBY, owned and operated by Cumulus Media Holdings Inc. or one of its subsidiary companies, at 1376 Walter Street, Suite 6, Ventura, CA 93003 during normal business hours Monday through Friday, or by sending a self-addressed, stamped envelope to the above address.

The Stations will conduct the “Kirby Kia Holiday Free Ride” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

                    No purchase is necessary.  Void where prohibited.  All federal, state, and local regulations apply

  1. Eligibility. This Contest is open only to legal U.S. residents age twenty-one (21) years or older at the time of entry with a valid Social Security number, and a valid California Drivers License, and who reside in the Station’s Designated Market Area (“DMA”) of Oxnard/Ventura, as defined by Nielsen Audio, who have not won a prize from the station in the last 90 days or a prize valued at $500 or more in the last 180 days, and whose immediate family members or household members have not won a prize from the station in the last 90 days or a prize valued at $500 or more in the last 180 days. Void where prohibited by law.  Employees of Cumulus Media Holdings Inc., its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.  Only one (1) immediate family member and/or household member may qualify and participate in the Grand Prize Drawing Event.  In the case of a dispute, the first (1st) Qualifier chosen will be deemed the participant for purposes of this Contest.
  2. Contest Period.The Contest will begin at 12:01AM, PT on Monday November 13, 2017 and will run through 11:59 AM PT on Thursday December 14, 2017 (the “Contest Period”).  The Grand Prize Drawing Event will take place at or
    about 12:00 Noon PT on December 16, 2017 at Kirby Kia in the Ventura Auto Center, 6424 Auto Center Dr, Ventura, CA 93003 and all Grand Prize Finalists must be present in order to win. The Station’s computer is the official time keeping device for this Contest.
  3. How to Enter. You will automatically be entered into the Contest once you complete one (1) of the following:

(i)  On-Air through 95.1 KBBY: Potential contestants should listen to the Station Weekdays from 10:01AM PT to 2:00PM PT and/or 3:00PM PT to 7:00PM PT during the Contest Period. When the Station Announcer, at random times during the Contest Period gives the cue-to-call, asking for the correct numbered caller, listeners should call the Station Contest Line at (805) 656-9595. The correct caller, as announced by the Station Announcer and determined by the Station in its sole discretion, will be entered into the Contest as a “Qualifier”, and receive one (1) entry to participate in the Grand Prize Finalist Drawing. Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.  A maximum of 47 contestants will Qualify via the On-Air method of entry 95.1 KBBY.
(ii)  On-Air through 103.7 KHAY: Potential contestants should listen to the Station Weekdays from 6:00AM PT to 10:00AM PT and/or 3:00PM PT to 7:00PM PT during the Contest Period. When the Station Announcer, at random times during the Contest Period gives the cue-to-call, asking for the correct numbered caller, listeners should call the Station Contest Line at (805) 650-5429. The correct caller, as announced by the Station Announcer and determined by the Station in its sole discretion, will be entered into the Contest as a “Qualifier”, and receive one (1) entry to participate in the Grand Prize Finalist Drawing. Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.  A maximum of 47 contestants will Qualify via the On-Air method of entry on 100.7 KHAY.
(iii)  Dealer Location EntriesContestants may also register for the “Kirby Kia Holiday Free Ride Contest” at the participating sponsor location, 6424 Auto Center Dr, Ventura, CA 93003. One “Entry Registration Box” will be present at the location, clearly marked and available to anyone satisfying the Eligibility requirements of the Stations Contest. Participants utilizing this entry method may enter to  and possibly be chosen as a Qualifier to participate in the Grand Prize Finalists Drawing. Limit one (1) entry per person, per family and/or household member, at this dealer location. To be eligible, entries must be deposited into the Entry Registration Box no later than 11:59 AM PT on Thursday December 14, 2017. A total of no more than 25 Qualifiers will be chosen via this entry method. A random drawing will occur at or about 12:30PM PT on December 14, 2017, exclusively from this Entry Registration Box, and those entries chosen will then will then be added to the total universe of Qualifiers, from which our Grand Prize Finalists will be selected.

 

  1. Grand Prize Finalist Selection.  At or about 1:00 PM PT on Thursday December 14, 2017, all one hundred nineteen (119) potential Qualifiers, from all valid Contest entry methods and from both participating radio stations, will be entered into a random drawing to select forty (40) Grand Prize Finalists, who will then each be eligible to participate in our Grand Prize Drawing Event, to be held Saturday December 16, 2017 from 10:00AM until 1:00 PM PT at Kirby Kia,  6424 Auto Center Dr, Ventura, CA 93003. Qualifiers selected in the Grand Prize Finalist Selection drawing will be contacted by Cumulus broadcasting using the telephone number or email address provided with the entry form and invited to participate as in the Grand Prize Event Drawing Event. Potential Grand Prize Finalists will have one (1) hour to respond to Stations initial contact. Failure to respond timely will result in a qualifier being disqualified from further participation in the contest. In such an event, Sponsor reserves the right to select an alternate Grand Prize Finalist  from a random drawing of all remaining eligible Qualifiers.
  2. Winner Selection; Grand Prize Drawing Event. On Saturday December 16, 2017, all forty (40) Grand Prize Finalists must attend the Grand Prize Drawing Event to be eligible to win the Grand Prize. The Stations Grand Prize Drawing Event will be held, from 10:00AM to 1:00PM, at the Kirby Kia dealership location at 6424 Auto Center Dr, Ventura, CA 93003, in the Ventura Auto Center.(i) Finalist Check In. All Contest Grand Prize Finalists must check-in at the event no later than 11:45 AM PT in order to participate in the Grand Prize Drawing Event. UPON CHECK-IN, EACH FINALIST MUST PRESENT A GOVERNMENT ISSUED, CURRENT AND VALID PHOTO ID, AND A VALID CALIFORNIA DRIVERS LICENSE. ONCE CHECKED IN, EACH FINALIST MUST BE PRESENT, AND REMAIN PRESENT, UNTIL THE GRAND PRIZE DRAWING TO BE ELIGIBLE TO WIN.

               Failure to check-in and/or present a valid, current photo ID by 11:45 AM PT. will lead to immediate disqualification from further participation in the Contest.  NO PROXIES WILL BE ALLOWED FOR ANY REASON.  Only one (1) immediate family member and/or household member may qualify and participate in the Grand Prize Drawing Event.  In the case of a dispute, the first (1st) Grand Prize Finalist chosen will be deemed the participant for purposes of this Contest

  1. (ii) Grand Prize Drawing. Upon check-in, in each Grand Prize Finalist will be given a number, depending upon the order in which the person checks in, starting with the number one (1) and going up to the number forty (40). Each Grand Prize Finalist  will be given a randomly selected and sealed “Winner CD”. The event host will randomly select a Grand Prize Finalist  number until a checked-in Grand Prize Finalist with that number identifies himself/herself.  When a checked-in Grand Prize Finalist’s name and/or number is called during the Grand Prize Event, the Grand Prize Finalist must identify himself/herself within thirty (30) seconds of his/her name/number being called and present a sealed Winner CD to the designated station representative. Failure to do so within the thirty (30) second timeframe will result in the checked-in Grand Prize Finalist being deemed “no longer present” for purposes of the Grand Prize Drawing Event. Once a checked in Grand Prize Finalist is identified, and his/her number called, that Grand Prize Finalist will give the station representative designated for this purpose their sealed Grand Prize Drawing Winner CD. The station representative will break the seal on the CD packaging and place the CD into the Grand Prize Kirby Rio’s onboard entertainment system. If the Grand Prize Winners Announcement is heard, and confirmed by the designated station representative, the contestant identified as the holder of that winning CD will win the Grand Prize, subject to verification of meeting the Eligibility requirements of the Contest, and meeting the minimum lease and insurance qualification terms. If the Grand Prize Finalist called does not win, then after each Grand Prize Finalists’s number is called, and the person with that number either participates in the Grand Prize Drawing or is eliminated, that number will be removed from the random drawing, and the host will select the next number. This process will continue until a Grand Prize Finalist with the winning Grand Prize Drawing Winner CD is identified and is declared the Winner. In the unlikely event that no winner is found during this process, the station at its sole discretion, will select a random winner using the numbers each Grand Prize Finalist received at check-in. The host will select a number at random from all the Grand Prize Finalists still present at the Grand Prize Drawing Event, and that Grand Prize Finalist will have the opportunity to meet Eligibility requirements of the Contest, and qualification of minimum lease terms. This process will continue until a winner is determined.
  2. Verification of Potential Winner. POTENTIAL CONTEST WINNER IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Must be 21 or older.  Must have valid California driver’s license.  Must have & be qualified for proper insurance of the Contest vehicle. Winner must be financially qualified for the vehicle. Winner will receive an IRS Form 1099 on value of lease: approx ARV $4,466 . Winner must be present to win (12:00 Noon PT December 16, 2017). The potential winner will be required to sign on-site, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable.  A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the Contest Prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
  3. Grand Prize. There will be One (1) Grand Prize awarded in this Contest.  A one (1) year lease of the “Holiday Free Ride” Kirby Kia Rio, subject to meeting the minimum credit, lease and insurance qualifications as established by Sponsor.  If Winner does not qualify or does not wish to take possession of vehicle, winner may choose a $500 cash payout.  But, not both the lease and the $500 cash prize.  The Grand Prize is a one (1) year [12 month], 10,000 mile per year lease of the “Holiday Free Ride” Contest Kia Rio, valued at ARV $16,735 or $500 in cash ARV $500Kirby Kia (“Participating Sponsor”) is responsible for payment of the Grand Prize leased Vehicle License and Documentation Fees, plus California State Use Tax for the vehicle’s first year lease term. All expenses and fees associated with the Grand Prize receipt and/or use, not expressly included in the foregoing prize description, are the sole responsibility of the Winner. Once a Winner has indicated which Prize (the lease or the cash) he/she desires to accept, he/she may not change his or her mind and will be deemed to have accepted the prize, subject to verification of eligibility. Odds of winning the Grand Prize are one (1) in forty (40), but may depend on a number of factors including the number of eligible entries disqualified  during the Grand Prize Drawing Event and the number of Grand Prize Finalists who actually check-in and participate in the Grand Prize Drawing Event itself.  Station reserves the right to substitute any listed prize for one of equal or greater value for any reason.     
  4. Entry Conditions and Release. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Stations, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Stations, Cumulus Media Inc., and its subsidiaries, related and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize.
  5. Publicity. Except where prohibited, participation in the Contest constitutes winner’s consent to Stations and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.
  6. Taxes. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
  7. General Conditions. Stations reserve the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Stations reasonable control impairs the integrity or proper functioning of the Contest, as determined by Stations in their sole discretion. Stations reserve the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Stations reserve the right to seek damages from any such person to the fullest extent permitted by law. Stations failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  8. 12. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance or completion of the Contest, or any part of it, for any reason, Stations, at their discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reason causes more than stated number of prizes as set forth in these Official Rules to be available or claimed, Stations reserve the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
  9. Disputes. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Stations listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state in which the Stations are located, without giving effect to any choice of law or conflict of law rules (whether of the state in which the Stations are located or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state in which the Stations are located.
  10. Entrant’s Personal Information. Information collected from entrants is subject to Stations Privacy Policy, which is available on the Stations individual websites under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Stations to be used, disposed of or destroyed in its sole discretion. Stations are not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.
  11. Contest Results. A winners list may be obtained within thirty (30) days after the Contest Period expires by sending a self-addressed stamped envelope to the Contest Sponsor identified below.

  3. How to Enter. You will automatically be entered into the Contest once you complete one of the following:

Online: (i) Entrants who have already become a member of the 100.7 KHAY VIP Club are eligible to participate in this contest by virtue of their prior registration . (ii) Those entrants that visit the Station’s website at www.khay.com during the Contest Period, (iii) click on the “Ventura County Ballet Presents The Nutcracker” image, and (iv) complete an entry form by the deadline stated above become eligible to Participate in this Contest.  All entries must be received by 10:30 am PT on December 1, 2017 to be eligible.  Limit one (1) entry per person, per email address.  Multiple participants are not permitted to share the same email address. Any attempt by any participant to submit more than one (1) entry per person by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entry and the participant may be disqualified.  Use of any automated system to participate is prohibited and will result in disqualification. Station is not responsible for lost, late, incomplete, invalid, unintelligible, inappropriate or misdirected registrations, all of which will be disqualified.  In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The “authorized account holder” is the natural person assigned the telephone number by the wireless carrier or an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  Potential winner may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Station and will not be returned.  Station reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion.  No mail-in entries will be accepted.

  1. Winner Selection. Each entrant to “The Nutcracker” contest who has become a member of the 100.7 KHAY VIP Club, and those entrants who already a registered member of the 100.7 KHAY VIP Club, are eligible to receive one (1) pair of tickets to see “The Nutcracker” event, at the Oxnard Performing Arts Center on December 2, 2017 or December 3, 2017. (ARV is $70.00). On or about 11:00 am PT each afternoon during the Contest Period, Station will select two (1) random members of the 100.7 KHAY VIP Club from all entries received by Station, up to that point in time, on their website up to that point during the Contest Period. The selected daily winner will each receive (1) one pair of (two (2)) tickets to see The Nutcracker. Winning entrants will be contacted using the email address and/or telephone number provided with their entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification. Each ticket to The Nutcracker has upon it a  Date on which it may be used, plus Terms and Conditions, over which “Station” has no control. It is the individual winner’s responsibility to use their tickets in accordance with these conditions, at the location indicated, and within the time period specified on each ticket.  Tickets that expire prior to use or that are lost will not be replaced for any reason. Tickets have no cash value beyond their use at Sponsor location.
  2. Verification of Potential Winner. POTENTIAL CONTEST WINNER IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email and/or telephone call after the date of random drawing and/or winner determination. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable.  A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the Contest Prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.    
  3. Five (5) prizes will be awarded in this contest.  Each Prize is a pair of (two (2)) tickets to see “The Nutcracker” event, at the Oxnard Performing Arts Center on December 2, 2017 or December 3, 2017. (ARV is $70.00). Winner is responsible for all taxes associated with prize receipt and/or use.  Odds of winning the Grand Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time. Station reserves the right to substitute any listed prize for one of equal or greater value for any reason.     
  4. Entry Conditions and Release. Except where prohibited, participation in the Contest constitutes winner’s consent to Station’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.
  6. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
  7. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  8. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance or completion of the Contest, or any part of it, for any reason, Station, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reason causes more than stated number of prizes as set forth in these Official Rules to be available or claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. The Station will conduct the 100.7 KHAY “Shania Twain Concert” Contest (the “Contest”) substantially as described
in these  rules, and by participating, each participant agrees as follows:

    No purchase is necessary.  Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents age eighteen (18) years or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) of Oxnard/Ventura as defined by Nielsen Audio, who have not won a prize from the station in the last 30 days or a prize valued at $500 or more in the last 90 days, and whose immediate family members or household members have not won a prize from the station in the last 30 days or a prize valued at $500 or more in the last 90 daysVoid where prohibited by law.  Employees of Cumulus Media Holdings Inc., its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

  1. Contest Period. The Contest will begin at 6:01AM PT on August 28, 2017 and will run through 7:00PM PT on September 1, 2017 in two distinct time blocks, Weekdays from 6:01AM PT to 9:00AM PT and Weekdays 3:01PM PT to 7:00PM PT (the “Contest Period”). The Station’s computer is the official time keeping device for this Contest.
  2. How to Enter. You will automatically be entered into the Contest once you do the following:

(i) On-Air: Potential contestants should listen to the Station Weekdays from 6:01AM PT to 9:00AM PT and Weekdays 3:01PM PT to 7:00PM PT during the Contest Period. When the Station Announcer, at random times during the Contest Period, asks for the correct numbered caller, listeners should call the Station Contest Line at (805) 650-5429. The “Designated” Caller to the Station, as determined by the Station in its sole discretion, will be entered as our winner.
Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.

  1. Winner Selection. Station will select two (2) call-in contest winners per weekday, one (1) winner to be selected in each of our two weekday Contest Periods. Winners will be the Correct Numbered Caller that the on-air announcer designates at the time the cue-to-call is given for that day and at that time. The winning entrant will be notified immediately by the on-air announcer that they have won the contest for that day and time. All winners are subject to verification of eligibility and compliance with the terms of these rules. Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification.
  2. Verification of Potential Winner. POTENTIAL CONTEST WINNER IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email and/or telephone call when to pick up their prize. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable. A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the Contest Prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
  7. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  8. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance or completion of the Contest, or any part of it, for any reason, Station, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reason causes more than stated number of prizes as set forth in these Official Rules to be available or claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
  9. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state in which the Station is located, without giving effect to any choice of law or conflict of law rules (whether of the state in which the Station is located or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state in which the Station is located.
  10. Entrant’s Personal Information. Information collected from entrants is subject to Station’s Privacy Policy, which is available on the Station’s website under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.
  11. Contest Results. A winners list may be obtained within thirty (30) days after the Contest Period expires by sending a self-addressed stamped envelope to the Contest Sponsor identified below.
